These Terms of Service ("Terms") govern your access to and use of thebrandbuddies.co (the "Site") operated by The Brand Buddies LLC ("The Brand Buddies," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Acceptance of these terms
By visiting the Site, booking a call, or otherwise interacting with us through the Site, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Disclaimer, which are incorporated by reference.
2. About our services
The Site presents information about our TikTok Shop growth services, including affiliate program management, paid media, and shop operations. The Site itself does not create a client relationship. Any engagement to provide services is governed by a separate written agreement or statement of work signed by both parties, which will control if it conflicts with these Terms.
3. No guarantee of results
The case studies, metrics, testimonials, and figures shown on the Site reflect the actual results of specific clients in specific circumstances. They are not a promise, projection, or guarantee that you will achieve similar results. 4. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site or engage our services. By using the Site, you represent that you meet these requirements and, if acting for a business, that you are authorized to act on its behalf.
5. Intellectual property
The Site and its content, including text, graphics, logos, design, copy, the "Brand Buddies" name, and our 6 Step Growth System framework, are owned by or licensed to The Brand Buddies LLC and are protected by intellectual property laws. You may not copy, reproduce, republish, or distribute our content without our prior written permission. Third-party names, logos, and trademarks shown on the Site (including TikTok and client brand marks) are the property of their respective owners and are used for identification purposes only.
6. Acceptable use
You agree not to misuse the Site. You will not attempt to gain unauthorized access to the Site, interfere with its operation, introduce malicious code, scrape or harvest data without permission, or use the Site for any unlawful purpose.
7. Third-party links and services
The Site links to and integrates third-party services such as Calendly (scheduling), YouTube (video), Notion (case studies), and social media platforms. We do not control these services and are not responsible for their content, policies, or practices. Your use of third-party services is governed by their own terms and privacy policies.
8. Communications and bookings
When you book a strategy call or contact us, you consent to receive communications from us related to your request. Booking a call does not obligate either party to enter into a paid engagement. You may opt out of non-essential communications at any time.
9. Disclaimer of warranties
The Site is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error free, or free of harmful components, or that any information on the Site is accurate, complete, or current.
10. Limitation of liability
To the fullest extent permitted by law, The Brand Buddies LLC and its members, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Site will not exceed one hundred US dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless The Brand Buddies LLC and its members, officers, employees, and contractors from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of your use of the Site or your violation of these Terms.
12. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction.
13. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
14. Severability and entire agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy and Disclaimer, are the entire agreement between you and us regarding your use of the Site.
